Definitions

In the Terms and Conditions the following definitions apply:

Urban Training, Urban Trainer, company, we, us, our
Means WebMotionUK.com Ltd

Subscriber, Agent, Professional(s), Personal Trainers, Group Fitness Trainers
Means Person or Persons subscribed to Urban Training internet services and websites.

Clients, Preferred Customer, Person who is

1. A direct customer or client of the Subscriber.
2. A Visitor who is not affiliated with any Subscriber.

Content is Protected by Intellectual Property & Copyright Laws

Text and image files, audio and video clips, and other content on this website is the property of the Urban Trainer and is protected by copyright and other restrictions. Copyrights and other proprietary rights in the content on this website may also be owned by individuals and entities other than, and in addition to, the Urban Trainer. Urban Trainer expressly prohibits the copying, modifying, disassembly, decompilation, reverse engineering or merging with any other software.

Any Parties who have done so will face legal action.

Commercial use is Restricted

Unauthorized commercial publication or exploitation of text, images or content of this website is specifically prohibited. Anyone wishing to use any of these files or images for commercial use, publication, or any purpose, must request and receive prior written permission from the Urban Trainer. Permission for such use is granted on a case-by-case basis at the sole discretion of Urban Trainer. A usage fee may be assessed depending on the type and nature of the proposed use.

Subscription Terms

1. CONTRACT INFORMATION - A contract arises between us once payment has been received and we accept the Contract. This contract will be governed by the laws of the state and in which you have signed up.
2. ACCEPTANCE BY Urban Trainer OF THIS CONTRACT - If there is any conflict between what is set out in this information, these terms and conditions will prevail. User must agree to all the terms and conditions set forth in this contract.
3. SUBSCRIPTION ENTITLEMENT - As soon as a contract is formed in accordance with Paragraph 1, you will be bound by these Subscription Terms not dependent on the amount of times you utilize the website. Subscriptions are non-transferable and non-refundable except as permitted in these Subscription Terms.
4. ACCESS TO WEBSITE - You will assign yourself a password on sign up. Please safe-guard your password. Urban Trainer will not be held responsible for damages or losses due to insecure passwords, sharing of passwords and general neglect for the Subscriber's account. It is the responsibility of the Subscriber to ensure their password is kept private and safe.
5. PAYMENT OF FEES - All Fees are payable in UK Pounds (£GBP) ONLY. All subscriptions are paid either 3 monthly, 6 monthly or yearly in advance. Subscriptions are automatically renewed at the end of their cycle unless you explicitly chose not to. Renewing an expired subscription will incur a setup fee. Your renewed membership will be on the membership terms current at the time. The minimum membership period can be 3 months, 6 months or 12 months, based on the subscription type you select. At the time of placing the order, the transaction details are presented to the bank and an authorization is obtained for the amount of the order. Payment is only collected when the order is completed.
6. MONEY OUTSTANDING - If any amount payable for your subscription is not paid on the due date, access to the website will be suspended until such time as payments are up to date (late fees of up to £15 per transaction and recovery costs may be charged). Any monies outstanding for other services or in store purchases may be automatically deducted from the supplied account/credit card details if not paid online.
7. TERMINATION OF SUBSCRIPTION & DEPATURE FEE - If you wish to cancel your subscription for any reason, you may do so by written notice to us. A departure fee will be charged depending on the number of months left on the contract. For remaining time of 4-12 weeks/1-3 months £30, 13-26 weeks/4-6 months £60, 27-40 weeks/7-9 months £90 and 41-52 weeks/10-12 months £120 will be payable. Unless you cancel, your subscription will automatically renew after the subscription term you selected when signing up, and then on an ongoing basis for membership and billing.
8. INVESTMENT INCREASE - We reserve the right at any time, after a minimum period on contract, to increase the fees to be charged and will use reasonable endeavors to give written notice to the most current email address you have supplied at least one month prior to this occurring. You will be taken to have received notices sent to your email address on the second business day after we have sent them. If subscription fees are increased, you hereby authorize the Company to increase any direct debits to your credit card or bank account which you have authorized upon subscribing.
9. CHANGE OF DETAILS - You must keep us informed of any change of address, email address, contact numbers, bank account and credit card details for payment and any other information relating to your subscription.
10. SUBSCRIBERS - Services provided by subscribers. Any claim that Clients or Preferred Customers might have as a result of an act or failure to act by such a subscriber (whether or not payment has been made to the contractor) will be brought against, and will be the responsibility of, that subscriber and not us. Subscribers, Clients and Preferred Customers hereby release, and indemnify and keep indemnified, is for any claim suffered by you as a result of an act or omission by a subscriber engaged by the Company. The Company will at all times assist, where possible, to resolve any conflict or issues with subscribers.

Website Usage Terms

1. As a user of the Sites, you agree that you shall download and/or use Content solely for your personal, non-commercial use. You agree to all of the terms and conditions set forth herein and will not use the Site(s) until and unless you have agreed to these terms and conditions. You may not use the Content in any matter inconsistent with this Member Agreement ("Agreement") or applicable law, and you may not copy, modify or alter the Content without Urban Training's express prior written consent.
2. Urban Training expressly reserves the right, in its sole and absolute discretion, to alter or amend any criteria, service or information set out in this website without notice.
3. The site contains information, data, documents, pages and images prepared by Agents of Urban Training. The information contained in this site is derived from various third parties and is neither endorsed nor supported by Urban Training.
4. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties on the Sites or on sites that are linked to the Sites, including information providers, are those of the respective third parties, and not Urban Training. Urban Training does not guarantee the accuracy, completeness, or usefulness of any third party content. Furthermore, Urban Training neither endorse nor are responsible for the accuracy and reliability of any opinion, advice, or statement made on any of the Sites or on any site that might be linked to the Sites by anyone other than an authorized Urban Training representatives acting in their official capacity. Urban Training and its employees or Agents shall have no liability (including liability by reason of negligence) to the users for any loss, damage, cost or expense incurred or arising by reason of any person using or relying on the information and whether caused by reason of any error, negligent act, omission or misinterpretation in the Information or otherwise.

Bookings

1. Urban Training will not be held liable for any cost or expense incurred by bookings made by the Subscriber or Customer. All bookings performed must be finalized unless stated by the Agent.
2. All bookings made are final 24 hours before chosen date and time. Any further changes must be made 24 hours before initial bookings, unless previously arranged. No-shows when bookings are finalized will be counted a "Used-Session" and deducted from your Training Credits. If these training sessions have not been paid for, your trainer will bill you for it. Failure to finalize payment within three working days will result in overdue fees of £5 a week.

Purchasing from the shop

1. Anyone browsing www.urbantrainer.co.uk are allowed to purchase products from the Online Store. All purchases made will be done electronically. Receipts will be sent via email.
2. The price of each product is displayed with the product. In the event of a sale or special offer, the discounted price is displayed.

Delivery Policy

Following successful registration and payment, confirmation e-mails and receipts will be sent as follows:

1. All website usage orders will be processed within 3 working days.
2. We will notify you via e-mail when your order has been processed.
3. All product orders take upto 14 days. Please allow 14 days from time of order for receipt of your product within UK.
4. Orders are sent via Royal Mail and sometimes may vary, the days mentioned above are estimates only.
5. Postage will be based on prices set by Royal Mail.

Returns

Please select your purchases carefully. You may return any unopened item within 7 days of receiving it for an exchange or a voucher of the value you have purchased. We will not exchange an opened or damaged item.

Before returning a product, you will need to adhere to our returns authorisation procedure by emailing us through our contact section with a subject of "I would like to return a product". We will email you with instructions on how and where to send the product and a returns authorisation number. Please note that we reserve the right to refuse any return that does not include a returns authorisation number.

We will ask you if you would like us to replace the item (provided it is still available) or refund your card. Please allow up to 2 weeks to process any returns.

If we make a mistake and send you an incorrect order, tell us by our contact section within 5 days of receipt of the product. We will credit your card for the cost of the item plus postage, and debit your card when we send you the correct order.

Export restrictions

We do not deliver any goods outside of UK, all transactions made from visitors outside of UK will be cancelled and may incurr a processing charge of upto £10 GBP

Security Policy

For credit card transactions, UrbanTrainer adds security by using 128bit Secure Sockets Layer (SSL) technology. This means that the credit card information you send is encrypted by your computer, and then decrypted again on our side, preventing others from accessing your private information in between. So, when using an SSL capable browser, purchasing/paying on UrbanTrainer's website is the safest kind of transaction possible with a credit card. Ensure that you see "https://www.urbantrainer.co.uk/..." in the URL on any pages that require input of your personal/card details.

Policy Changes

Changing technology, and legal developments, this Policy may be changed from time to time in Urban Trainer's sole discretion and without any prior notice or liability to you or any other person.
